These Terms of Service, together with the SMARTEST DATA Privacy Policy (the “Privacy Policy”) which shall henceforth be referred to as the “Agreement” is a legal agreement between you (“you”, or “the user”) and SMARTEST DATA (“SMARTEST DATA”, “we” or “us”) accessing, installing or in the future using the SMARTEST DATA mobile application (the “App”) or using or receiving any services from our “Site(s)” you confirm that you accept the “Agreement” whereby you avail of the SMARTEST DATA service, whereby we provide a marketing and technology platform for the purposes of providing information using third party data which could be used in the valuation of the EQUITY MARKET and associated securities. (the SMARTEST DATA “Service”).

Your use of the SMARTEST DATA Service and Site(s)s and Products, constitutes your agreement with the terms and conditions which are set out below. We recommend that you read these terms and conditions fully before use of the Site(s) or Service and if you do not agree with all of them, please do not use the SMARTEST DATA Site(s),Service or Purchase Products.

SMARTEST DATA, via the website sells various products, Print on Demand services, Dropshipping and Amazon. In the case where you would like to return a product with a default. You have 14 days from the receipt of the product to do so and the product must be returned in its original packaging. One the product has been returned to the supplier and they agree to the refund, the refund will be made within normal business conditions and this is very unlikely to be more than 3 months. Any dispute must lodged in Switzerland in the Canton of Ticino. The Courts in Ticino are the Courts of jurisdiction over any and all disputes.

SMARTEST DATA reserves the right to change these Terms of Service at any time and without prior notice. You agree that each visit you make to the Site(s)(s) shall constitute you being bound by the Terms of Service and Privacy Policy that are active at that time and that your continued use of the Site(s)(s) and Service constitutes agreement that you have read and agree to be bound by all modifications made.

TERMS OF SERVICE: APPLICATION AND ACCEPTANCE

By downloading, using, viewing, accessing, browsing or submitting any material or content on the Site(s)(s) you accept to be bound by these Terms of Service and the Privacy Policy as a legal agreement between you and SMARTEST DATA, sans limitation or qualification.

You also confirm that you are at least 18 years of age and that you have provided accurate information upon registration including: full given name, mobile telephone number, email address and that you are not a professional Investor (in any capacity) working for a Financial Institution “an Institutional Investor”.

License of Users of the Site(s) and APP

As a User, SMARTEST DATA gives you permission, on the understanding that it may be revoked at any time and for any or no reason, to access the Site(s) and to download, email, share via social media or print pages from the Site(s) according to this Agreement and solely for the purposes or either You may not remove designated trademarks contained on such pages.
You may not misuse the SMARTEST DATA service by incorporating material gathered on the Site(s) into any form of archive, cache, compilation or database.
You may not copy, re-publish, display, reproduce, reuse, license, resell, publish, perform, transmit, distribute or modify any of the material from the Site(s).
You may not resell any products purchased through the Site(s).
You may not deep-link to the Site(s) for any purpose or attempt to access the Site(s) either manually or with any robot, spider, web crawler, extraction software or automated process or device to either monitor or copy any amount of information on the Site(s).
Any linking or framing of any of the pages of the Site(s) must only be done after receiving the prior written consent of SMARTEST DATA.
You are permitted, as a User, to like or follow SMARTEST DATA on any of our social media pages and to share links to the Site(s) on your personal social media page or in reasonable groups.
The license granted to you, as a User, to use the Site(s) and avail of the SMARTEST DATA Service will be terminated immediately if you do not comply with the Agreement. SMARTEST DATA reserves all of its rights. under Irish statutory and common law against any person, or legal entity, who violates these terms.
Your use of the Site(s) and the SMARTEST DATA Service is subject to all applicable ethical standards. In addition, you agree (i) to conduct yourself online, especially with regard to the posting of acceptable content, in according with Irish laws, (ii) not to use the Site(s) or avail of the SMARTEST DATA service if you are under the age of eighteen (18) or unable to present all forms of identification laid out in this, (iii) or gainfully employed as a professional Investor (in any capacity) working for a Financial Institution “an Institutional Investor”.
You furthermore agree that the consequences of improper commercial use may be so serious that compensation in a purely monetary form may be insufficient and that SMARTEST DATA will be fully entitled to either temporary or injunctive relief to protect our rights (v) not to attempt to interfere with the use of the Site(s) by another individual, including attempt to access other computer systems through the Site(s), uploading or transmitting viruses or other harmful or destructive files, or by interfering with or otherwise harming the security of the Site(s) or any services, accounts, passwords, servers or networks connected to or accessible through the Site(s) or those belonging to our Partner Stores.
You agree to defend, indemnify, and hold SMARTEST DATA Parties harmless from any and all suits, actions, legal or administrative proceedings, claims, demands, damages, liabilities, and expenses, including attorney's fees and costs, arising in connection with a violation of this Agreement by you or through use of your account.
